Donald Trump's Attempt At Presidency Faces 14th Amendment Roadblock, Says Rep. Adam Schiff

Representative Adam Schiff (D-Calif.) contends that former president Donald Trump’s disqualification from public office is in line with the stipulations of the 14th Amendment.

What Happened: As reported by The Hill, Schiff stated that the 14th Amendment, which prohibits those involved in insurrection from assuming office, presents a “valid” argument for barring Trump from future candidacy.

Schiff underlined that the Amendment does not require a formal conviction of insurrection but merely involvement in it. “It’s a disqualification from holding office again, and it fits Trump to a T,” Schiff asserted.

During his conversation on MSNBC’s “Inside with Jen Psaki,” Schiff, who served on the committee investigating the Jan. 6 attack on the Capitol, suggested that this legal theory might be tested by a secretary of state or a litigant challenging Trump’s name on the ballot. He anticipates that the issue could potentially escalate to the Supreme Court.

Why It Matters: Schiff’s contention is part of a broader discussion about Trump’s potential disqualification from future office.

 Previously Rep Jamie, Rep. Jamie Raskin (D-Md.) argued that Trump, the current Republican forerunner for the 2024 elections, is barred from a future presidential bid due to his involvement in the 2021 Capitol attack. 

Liberal groups have also indicated a readiness to challenge Trump’s candidacy in court, citing the 14th Amendment. Legal scholars have further posited that the mounting legal evidence against Trump may preclude his 2024 run under Section 3 of the Fourteenth Amendment.

These developments come amidst indications that despite facing multiple indictments, Trump could still legally run for office. However, the final decision rests with the court, and the debate continues.
