Donald Trump Allies Denounce 14th Amendment Disqualification Push As Groundless: 'Absurd Conspiracy Theory'

The former president’s allies have refuted claims by two top Democrats, suggesting that Donald Trump could be excluded from the 2024 presidential ballot under the 14th Amendment’s “insurrection clause.”

What Happened: Rep. Adam Schiff (D-Calif.) and Sen. Tim Kaine (D-Va.) argued that there’s a robust case for barring Trump from the ballot due to Section 3 of the Amendment. This section prohibits anyone who “engaged in insurrection” against the U.S. from holding elected office.

A Trump campaign spokesperson labeled this as an “absurd conspiracy theory,” reported Axios.

“The people who are pursuing this absurd conspiracy theory and political attack on President Trump are stretching the law beyond recognition much like the political prosecutors in New York, Georgia, and DC.,” the spokesperson said.

“There is no legal basis for this effort except in the minds of those who are pushing it.”

Election officials in various states are currently probing whether Trump’s name should be eliminated from the 2024 ballot under the 14th Amendment clause. Two prominent conservative law professors, William Baude and Michael Paulsen, have written that there is a basis for disqualifying Trump under this clause.

Last month, GOP candidate and former Arkansas governor Asa Hutchinson also raised questions about Trump’s eligibility to run for office again due to the 14th Amendment. Hutchinson also cited Trump’s actions on Jan. 6 and said it could have disqualified him from a future presidency.

A Florida lawyer, Lawrence Caplan, has also filed a challenge in federal court questioning Trump’s potential 2024 presidential bid.

Meanwhile, Trump denies any wrongdoing in the criminal cases against him and has pleaded not guilty in three of them, including a federal Jan. 6 case alleging that he plotted to overturn Joe Biden’s victory in the 2020 election.
