Deutsche Bank published a managed care industry alert report that stated: "As indicated in the NAIC press conference held on 9/22, the draft NAIC regulation excludes from the premium calculation (for the purpose of MLR rebates) federal and state taxes, with the exception of certain items such as taxes on investment income and cap gains. This is the preferred approach for the MCO industry since it will result in higher MLR calculations (and thus require lower amounts of rebates) than if federal and state taxes were included in the premium calculation."
