As the golden sun dips below the horizon of Tolhuin, Tierra del Fuego, Soledad Gareka, a lawyer and president of the NGO Tolweed Club Cannabico, embarks on a mission unlike any other. Accompanied by fellow members of her organization, Gareka embarks on a journey to Colombia. Their mission? To transport medicinal cannabis legally, a historic milestone in the fight for the legal recognition of cannabis medicine in Latin America.
The move was carefully orchestrated. To ensure legality, Gareka reached out to the Ministry of Health in Colombia via email, seeking clarification on the lawfulness of her action. The response she received was not only positive, but also congruent with the legislation she had cited in her request.
To lend further credibility to the legal travel and transportation of medicinal cannabis, Gareka drew on two key documents: a REPROCANN (medical cannabis) permit from Argentina and a medical prescription from Colombia. The latter was procured online, facilitated by the Colombian team of Procannamed.
"The idea is to make visible the need to respect the health rights of users to maintain our treatments even when traveling," Gareka told El Planteo's Natalia Kesselman. "As a mother of a child undergoing cannabis treatment, I took preventative measures by seeking prior consultation. The recommendation is always to consult beforehand, as one does not stop putting oneself on the line for the respect of a right while we have a legal system that continues to leave us adrift in many aspects. Health is a human right that we have to defend as users!"
Significantly, both Argentina and Colombia have regulatory frameworks for the medical use of cannabis, with the former's being managed by REPROCANN.
Gareka's journey echoes an earlier voyage in March when Piero Liebman, founder of Liebman & Asociados Abogados, a law firm specializing in cannabis and hemp regulations, entered Spain legally carrying marijuana. His experience became a sensation at the Spannabis Expo held in Barcelona.
The Expo was abuzz with excitement as Argentinian-grown cannabis flowers were on display, showcasing the quality of the country's botanical produce. The occasion served as an international endorsement of REPROCANN and highlighted its crucial role in upholding human rights.
Through the actions of Gareka and others like her, it has been shown that the law can be used to protect and promote health rights, as long as the rules of the land are observed and respected. It also marks a significant step forward in the push for wider acceptance and use of cannabis in medicine.
