Gov Newsom Green Lights Medical Psychedelics If Rescheduled And New Marijuana Testing Rules

California’s Governor Gavin Newsom (D) signed two of several psychedelics and marijuana proposals.

The Bills

AB1021 enables “a physician, pharmacist, or other authorized healing arts licensee acting within their scope of practice” to prescribe and dispense current Schedule I drugs -including the designated “breakthrough therapies” concerning psilocybin and MDMA- once their federal status changes reported Marijuana Moment’s Kyle Jaeger.

Meanwhile, AB623 calls on the Dept. of Cannabis Control to amend THC variance testing rules for marijuana products toward developing more “appropriate” ones for cases with lower levels of THC than the specified ones in the existing legislation.

Decision-Pending And Approved Drug Reform Bills

In the psychedelics realm, the proposal noticeably awaiting for the governor’s call is SB58 legalizing adult possession and cultivation of psilocybin, psilocin, DMT and mescaline (with several amendments to the original version.)

In terms of cannabis, the other measures would prevent employers from asking applicants about marijuana use, allow chronically ill patients over 65 to use marijuana at healthcare centers, legalize cannabis cafes, promote sustainable plant tagging and include cannabis packaging and labeling restrictions. Recently enacted measures grant immunity to people possessing personal use amounts of any controlled substance if they test it for adulterants like fentanyl, show positive tests to law enforcement and inform where they obtained the drug; allow the State Water Board to research for suspected illicit cannabis cultivators and engage in drug enforcement efforts; and modify background-check requirements for cannabis businesses.
