80% Of 'Delta-8 THC' Products In North Carolina Are Illegal & Mislabeled, Some Don't Differ From Marijuana

While North Carolina remains one of only a few states where cannabis remains illegal for both recreational and medical purposes (except for very limited medical use), it seems there is no shortage of THC-infused products available at convenience stores.

What's going on: NBC’s affiliate for the Research Triangle area, a television station WRAL-TV decided to investigate some of the popular products sold at convenience stores and gas stations, which are marketed to provide “legal high.”

How can any of these products be marketed as legal if marijuana-infused products are not in North Carolina? The reason is because scientists have found a way to convert CBD compounds naturally found in both hemp and cannabis plants into delta-8 THC, which is known to produce a mild psychoactive effect in some people similar to delta-9 THC. With the 2018 Farm Bill hemp (marijuana with only .3% delta 9 THC) became legal and this created a perfect gray area for those wanting to create “legal THC.”

The problem is that many of these “legal” products are not properly labeled and some of them are definitely not legal, say local media.

WRAL-TV’ Sarah Kroger, bought some of these gummies, vapes and cookies and took them to be analyzed by Michael Horton and Frank Maurio with Raleigh-based Delta 9 Analytical. Kroger discovered that “what you see on the label, isn’t usually what you get.”

After analysis, Horton confirmed: "What we found we’ve got quite a bit of Delta 9 THC.”

Why it matters: Maurio summarized the results concluding that "Four of the five are not legal products in North Carolina, and four of five are not labeled properly." Maurio says he's not surprised by these results.

Analysis revealed the following:

  • The Gold Silver gummies were mislabeled as far as the type of THC, and were over the limit for THC content.
  • The Insane Gummies only contained one of three products on the label, but they were under the legal limit.
  • The Sweet Tooth vape was mislabeled and two times over the THC limit.
  • The Delta 10 Cake vape had NO Delta 10, but was still three times over the limit for THC.
  • Smokable Moon Rock pre-roll was the only thing properly labeled, but it was 10 times over the THC threshold.

“Incredibly, not a legal product,” Horton said.

Some of these products don’t differ from marijuana, Maurio concluded.

The two experts highlighted that mislabeled products like these are a threat to all of us because someone might consume them and then get into a car or start to operate machinery without knowing that what they consumed is highly psychoactive.

Similar things are happening in other states.
