Governor Polis Tackles Cannabis “Chicken And The Egg” Dilemma: Research Stunted By Prohibition

Colorado Governor Jared Polis highlighted the challenges in cannabis research due to federal prohibition, describing it as a “chicken and the egg” situation. In a recent interview, Polis stated this dilemma has impeded policy reform, as lack of research hinders legalization efforts, while prohibition restricts research.

Polis, along with five other state governors, recently urged President Biden to reschedule cannabis under the Controlled Substances Act (CSA) by the end of 2023. The U.S. Department of Health and Human Services (HHS) supports moving cannabis from Schedule I to Schedule III, awaiting the Drug Enforcement Administration’s (DEA) final decision.

The rescheduling of cannabis, although not legalizing marijuana federally, would facilitate tax normalization for state-legal businesses. As Marijuana Moment reported, Polis urged the DEA to recognize scientific facts and act on HHS’s recommendation.

Despite growing bipartisan support for legalization, Polis noted the role of congressional politics in maintaining prohibition. He argued for federal respect towards states’ decisions on marijuana policy, emphasizing personal responsibility and decision-making.

Bipartisan Push In PA: Cannabis Decriminalization Gains Momentum

A bipartisan effort led by state Sens. Sharif Street (D) and Camera Bartolotta (R) is underway to decriminalize cannabis, transforming simple possession from a misdemeanor to a civil offense. The proposed bill, SB 107, seeks to replace jail time with monetary fines: $25 for possession and $100 for public consumption.

According to Marijuana Moment, the initiative aligns with growing support for cannabis reform, as local governments in Philadelphia, Pittsburgh, and Erie have already enacted decriminalization ordinances. However, the state law remains unchanged. This legislative session presents an opportunity for change, especially with Democrats controlling the House and Governor Josh Shapiro advocating for legalization.

Street's broader vision includes legalization with a focus on social equity, emphasizing inclusivity in the burgeoning cannabis industry. Rep. Donna Bullock (D) stresses that any bill must include a robust equity program to gain her support. 

Amid regional shifts, Sen. John Fetterman (D-PA), recently said legalization is inevitable despite some republican opposition. With Ohio legalizing cannabis this month, Pennsylvania faces pressure to modernize its marijuana policies.
