South Africa Legalizes Cannabis Use In Private Settings, Says No To Sales And Yes To Home Grow

  • South Africa’s president Cyril Ramaphosa signed a bill to legalize cannabis possession and cultivation by adults.
  • Under the new law, cannabis will be removed from the Drugs and Drug Trafficking Act.
  • The measure also provides for the expungement of criminal records of persons convicted of possession or use of cannabis.

South African President Cyril Ramaphosa signed into law Tuesday the Cannabis for Private Purposes Act (CfPPA), which regulates the cultivation, possession and consumption of marijuana by adults in a private setting.

Under the CfPPA, cannabis is completely removed from the Drugs and Drug Trafficking Act, further allowing amendment of the Schedules to the Medicine and Related Substances Act as well as amendments to other measures that would enable the industrialization of the cannabis sector.

The news comes some six months after South Africa's National Assembly approved the bill, paving the way for the legalization of personal cannabis use. The loosening of cannabis laws in the country, started in 2018 with the judgment that decriminalized private cannabis use, signaling a possible turning point for South Africa's cannabis landscape.

The legislation regulates the medically prescribed administration of cannabis to a child, while also protecting children from undue exposure to cannabis. The measure, however, does not allow for legal marijuana sales, and adults need to cultivate their own plants and can only consume it in their private residences.

The measure also provides for the expungement of criminal records of persons convicted of possession or use of cannabis.
