Team Biden's Move To End Trump's 'Remain In Mexico' Immigration Policy Upended By Federal Judge

The Biden administration's efforts to end the “Remain in Mexico” immigration policy, put in place by Donald Trump’s administration, has reportedly encountered a legal hurdle.

What Happened: U.S. District Judge Matthew Kacsmaryk ruled that the policy, formally known as the Migrant Protection Protocols, should stay in force until legal challenges to it are resolved, reported The Hill. 

President Joe Biden had moved to end the policy under which more than 70,000 people seeking refuge in the United States were returned to Mexico, according to the report.

Texas and Missouri opposed Biden’s bringing an end to the policy and took legal action. The U.S. Supreme Court reportedly ruled 5-4 in June that the president could end the policy but at the same time tasked Kacsmaryk with finding out whether the action of the administration was “arbitrary and capricious” in violation of the Administrative Procedure Act, reported The Hill.

Why It Matters: Under the policy asylum seekers, including those not from Mexico, have been returned to Mexico to await the processing of their cases, noted The Hill.

Kacsmaryk, a Trump-appointed judge, ruled that Texas met all requirements for a preliminary injunction to be issued.

The judge ruled that the government didn’t consider states’ costs and reliance interests in federal immigration policy.
