Texas Attorney General Ken Paxton has filed a new lawsuit against Dallas, this time targeting Proposition R, a voter-approved amendment decriminalizing possession of up to four ounces of marijuana. The lawsuit marks <a href="https://www.benzinga.com/markets/cannabis/24/01/36880984/gop-attor-ney-gen-er-al-in-texas-sues-five-cities-to-stop-voter-approved-mar-i-jua-na-reform-say">the second time that Paxton has sued the city</a>, intensifying his legal battle against local cannabis reforms.
<h3 class="wp-block-heading">New Cannabis Decriminalization Rules Take Effect in Dallas</h3>
Proposition R, <a href="https://www.benzinga.com/markets/cannabis/24/11/41790734/texas-cannabis-election-dallas-lockhart-bastrop-voters-say-yes-to-marijuana-decriminalization">passed by 66% of Dallas voters on November 5</a>, prohibits police from making arrests or issuing citations for low-level marijuana possession. It also bars officers from using the smell of marijuana as probable cause, unless investigating felonies and mandates that misdemeanor marijuana offenses be a low enforcement priority.&nbsp;
<a href="https://www.dallasnews.com/news/politics/2024/11/21/ag-ken-paxton-sues-dallas-over-decriminalizing-marijuana/">According</a> to The Dallas Morning News, city officials began enforcing the amendment this week, despite warnings of legal challenges.
<h3 class="wp-block-heading">Texas AG Claims Cities Cannot Override State Drug Laws</h3>
Nevertheless, Paxton contends that the amendment violates state law, asserting that cities cannot override Texas drug statutes. &#8220;The city of Dallas has no authority to override Texas drug laws or prohibit the police from enforcing them,&#8221; Paxton <a href="https://texasattorneygeneral.gov/news/releases/attorney-general-ken-paxton-sues-city-dallas-ballot-measure-prohibiting-police-enforcing-marijuana">said</a> in a press release on Thursday. 
&#8220;This is a backdoor attempt to violate the Texas Constitution and any city that tries to constrain police in this fashion will be met swiftly with a lawsuit by my office,&#8221; he added.

<h3 class="wp-block-heading">Paxton Vs. Texas Voter-Backed Cannabis Reforms</h3>
This legal action is part of a broader effort by Paxton to challenge a <a href="https://www.benzinga.com/markets/cannabis/24/11/41764202/dallas-overwhelming-approves-cannabis-decriminalization-in-ballot-vote">statewide trend of voter-led initiatives aimed at decriminalizing cannabis</a>. Earlier this year, <a href="https://www.benzinga.com/markets/cannabis/24/02/37018142/texas-city-slated-to-decriminalize-weed-despite-ag-paxtons-lawsuit-against-five-cities-over-amne">he sued five other cities</a> -Austin, Denton, Elgin, Killeen and San Marcos- over similar measures.&nbsp;
Furthermore, Paxton has repeatedly argued that municipalities lack the authority to override state law, <a href="https://www.benzinga.com/markets/cannabis/24/01/36880984/gop-attor-ney-gen-er-al-in-texas-sues-five-cities-to-stop-voter-approved-mar-i-jua-na-reform-say">calling the actions of these cities</a> "pro-crime extremism."

Advocacy group Ground Game Texas (GGT), which supported Proposition R, criticized Paxton's lawsuit as baseless. The group argues that the amendment focuses on enforcement priorities rather than legalizing marijuana, making it compliant with state law. Supporters have also highlighted its potential to reduce racial disparities in arrests and prevent the misuse of public funds.
"It's unfortunate but not surprising that Attorney General Ken Paxton has apparently chosen to waste everyone's time and money by filing yet another baseless lawsuit against marijuana decriminalization," said Catina Voellinger, executive director of GGT, according to The Dallas Morning News.
This clash highlights the growing divide between Texas' restrictive cannabis laws and grassroots movements pushing for reform. Judges have previously <a href="https://www.benzinga.com/markets/cannabis/24/07/39946113/gop-attor-ney-gen-er-al-in-texas-loses-legal-battle-against-towns-with-decriminalized-cannabis-i">overturned Paxton's lawsuits against other cities</a>, but appeals remain ongoing.

California, known for its ideal climate and rich cannabis history, is regarded as one of the best places to grow weed. The state has also led U.S. cannabis reform, from the first legalization ballot initiative in 1972 to becoming the first state to legalize medical marijuana in 1996. A decade later, in 2016, it legalized recreational use. Since then, California, home to the world's largest cannabis market, has faced significant challenges.
Small pot farms in regions like the Emerald Triangle have struggled to survive due to oversupply and falling prices, <a href="https://www.sfgate.com/cannabis/article/california-cannabis-farms-struggle-19907579.php">writes</a> SF Gate. Issues like <a href="https://anresco.com/exclusive-we-tested-top-california-prerolls-for-potency-inflation/">inappropriate labeling</a>, lab shopping, and a <a href="https://www.benzinga.com/top-stories/24/06/39487551/pesticide-contamination-poses-serious-health-risks-in-californias-cannabis-industry">pesticide scandal</a> have also plagued the industry. While legal cannabis sales <a href="https://www.benzinga.com/markets/cannabis/24/06/39195663/legal-california-cannabis-market-on-the-verge-of-collapse-while-illegal-growers-thrive-destroyin">decline</a>, cartel operations <a href="https://www.benzinga.com/markets/cannabis/24/06/39188435/californias-cartel-cannabis-flourishes-in-national-parks-weed-grown-on-public-lands-accounts-for">thrive in national parks</a>.
To explore these challenges, we spoke to Josh Wurzer, chief compliance officer and co-founder of SC Labs, one of the first to raise concerns about pesticide testing. "From the beginning, our goal has been to be the most science-focused testing laboratory in the cannabis industry," Wurzer told Benzinga.
"We are committed to promoting safe cannabis consumption by ensuring the quality and safety of cannabis cultivation and product manufacturing. Our passion for the plant drives us to support research into its chemical composition, exploring how these compounds influence the flavor, aroma, and unique effects of different strains."
<h2 class="wp-block-heading">Pesticides, Inaccurate Labeling And Lab Shopping</h2>
In 2023, there was a <a href="https://www.benzinga.com/markets/cannabis/24/06/39505507/cannabis-recall-in-california-after-investigation-finds-dangerous-pesticides-in-popular-weed-pro">cannabis recall</a> after an investigation found dangerous pesticides in popular weed products and a lawsuit against <a href="https://www.benzinga.com/markets/cannabis/24/06/39533403/california-lawsuit-takes-aim-at-cannabis-lab-shopping-as-dangerous-pesticides-end-up-in-popular-">cannabis lab shopping</a>. According to Wurzer, who is also a board member of multiple cannabis industry organizations, including the U.S. Pharmacopeial Convention (USP), lab shopping has become a significant issue within the testing industry.
"This problem primarily stems from the fact that the THC concentration in cannabis and cannabis concentrates has become a key factor in determining the wholesale price of these products. This creates a strong incentive for growers and manufacturers to seek out laboratories that report the highest THC concentrations, regardless of the accuracy of the data," he said.
He added that cannabis is vulnerable to pests like spider mites and fungal pathogens like powdery mildew. With no approved pesticides and strict testing requirements, managing these threats is challenging and expensive. Some producers bypass detection by using lenient labs.
While regulators are in charge of overseeing the quality of lab testing, growers and producers are those financially impacted by unfavorable results, Wurzer adds. Without the enforcement of penalties for these actions, "unethical behavior is incentivized."
"I certainly don&#8217;t envy our regulators," he said. "Many of them are working hard to do the best they can within the constraints of the current rules and restrictions. It&#8217;s no small task to try and organize an industry that has been so fragmented, especially when so many people are struggling financially, and there are numerous competing interests at play."

<h2 class="wp-block-heading">Cannabis Will Likely Always Be Affected By HLVd</h2>
In 2019, a hop-latent viroid (HLVd) was identified as an infectious pathogen devastating cannabis farms in California by infiltrating plants and ruining entire crops just before they're ready for harvest. According to a 2021 estimate, it affected 90% of California cannabis crops.
Wurzer explained that cannabis will likely always be affected by HLVd, the same way that potato farmers are continuously plagued with the Mosai Virus. However, the cannabis industry has developed a support system that enables growers to mitigate HLVd&#8217;s effects. This has enabled the breeding of resistant strains, improving hygiene practices in nurseries and conducting regular monitoring through testing.
<h2 class="wp-block-heading">Fixing Some Of The Challenges</h2>
In view of HLVd, dangerous pesticides and inaccurate labeling, the question is: have California consumers lost trust in the state&#8217;s legal cannabis products? This could be one of the reasons why the illicit market is still thriving; consumers are turning to cheaper products. Wurzer notes that the price difference between regulated and black markets is significant.
Another challenge comes from the hemp market and the confusion about what is and is not legal. To save the industry, regulators need to address the competition from intoxicating cannabinoids in the hemp market, which is currently mostly unregulated and flooded with dangerous synthetic chemicals, he explains.
Wurzer suggests reducing taxes and regulatory burdens on growers and producers without compromising the quality and safety of products. Profiteers selling unsafe products need to be disincentivized, and ultimately, "the path forward must include federal legalization."
<h2 class="wp-block-heading">Finest Cannabis In The World</h2>
Wurzer believes there's no other place on earth that can match the quality of cannabis grown in California, and "as long as that remains true, we have a real opportunity to fix this mess."
Once cannabis is allowed to cross state lines, California will have a significant advantage, he adds. "No one will want to purchase inferior synthetic THC flowers from other states when they can get high-quality sun-grown flowers from Mendocino, Humboldt, and Santa Cruz. I&#8217;ll confidently put our sun-grown flowers up against the best indoor cannabis produced anywhere else in the world, and I have the lab data to back up those claims."
In April 2023, SC Labs partnered with another major laboratory network to develop the <a href="https://www.benzinga.com/markets/cannabis/23/04/31680816/sc-labs-and-act-laboratories-launch-trust-in-testing-certification-to-set-a-higher-standard-for-">Trust in Testing Certification</a> a set of enhanced national standards for cannabis testing. This program is "designed to address some of the gaps in state regulations that have allowed unscrupulous labs to produce questionable data or manipulate the system," Wurzer details. There's been a significant interest from retailers looking for a trustmark that provides confidence in the products they offer. SC Lab's goal is to establish a group of laboratories dedicated to doing things the right way.

Nike shares trade near 52-week lows after <a href="https://www.benzinga.com/news/earnings/24/10/41129610/nike-q1-earnings-revenue-miss-eps-beat-teams-energized-amid-ceo-transition-a-comeback-at-this-scale">first-quarter financial results</a> saw revenue miss analyst estimates and analysts weigh how quickly a new CEO can help turnaround the company.
"A comeback at this scale takes time, but we see early wins – from momentum in key sports to accelerating our pace of newness and innovation," Nike CFO Matthew Friend said after the Q1 results. "Our teams are energized as Elliott Hill returns to lead Nike's next stage of growth."

Analysts expect the company to report quarterly revenue of $1.56 billion, up from $1.41 billion in last year's third quarter. Analysts also expect quarterly earnings per share of $2.12, up from $2.07 in last year's third quarter. 
Autodesk has beaten analyst estimates for revenue and earnings per share both in five straight quarters. Over the last 10 quarters, Autodesk has beaten analyst estimates for revenue eight times and earnings per share eight times. The company said that it <a href="https://www.benzinga.com/news/earnings/24/08/40639874/autodesk-stock-jumps-5-on-q2-earnings-the-details">was focusing on </a>disciplined execution and seeing GAAP margins among the best in the sector.
Autodesk CEO Andrew Anagnost said these factors &#8220;will deliver sustainable shareholder value over many years.&#8221;

The Details: Super Micro, in the compliance plan, said it believes it will be able to file both its 2024 fiscal-year earnings and its 2025 fiscal-year first-quarter earnings within Nasdaq&#8217;s acceptable discretionary time.
Previously, the company reported that it was unable to file its earnings on time for multiple reasons, including the resignation of its previous independent accounting firm, Ernest &amp; Young. The company also explained that its management team needs to time to review the company&#8217;s financial statements and internal controls. 
On Monday the company <a href="https://www.benzinga.com//node/42111748">announced</a> that it has appointed BDO USA as its independent auditor.
"BDO is a highly respected accounting firm with global capabilities.&nbsp;This is an important next step to bring our financial statements current, an effort we are pursuing with both diligence and urgency," said&nbsp;Charles Liang, president and CEO of SuperMicro.

Donald Trump is back and so is the boom for Palantir (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/PLTR#NYSE">PLTR</a>) – and a couple of its early founders are reaping the benefits. Joe Lonsdale and Stephen Cohen, Peter Thiel&#8217;s close associates, joined the billionaire club thanks to a massive rise in Palantir&#8217;s stock value following Trump's reelection. They own only a small slice of the company – less than 2% each – but it&#8217;s more than enough to make them new billionaires.

Palantir, the secretive software company known for its work with government agencies, has seen its stock price shoot up more than 270% this year, <a href="https://www.benzinga.com/24/11/42094248/trumps-return-boosts-palantir-national-security-bets-drive-140-billion-market-cap">partly because of Trump's victory</a> and the expectation of increased defense spending. With deep ties to government contracts and projects that align well with Trump's priorities, investors seem to be betting big on Palantir's future.
Joe Lonsdale, who left Palantir in 2009, still holds about a 1% stake in the company, which Forbes estimates is worth roughly $1 billion. Lonsdale, who's been <a href="https://www.benzinga.com/general/politics/24/06/39557155/palantir-co-founders-thiel-lonsdale-back-trump-in-2024-election-id-rather-have-him-than-biden">vocal about his support for Trump's reelection</a>, called this moment &#8220;morning again in America&#8221; and tweeted, &#8220;Daddy&#8217;s Home.&#8221; Through his venture firm 8VC, he's invested in other defense and software companies, solidifying his role as a key figure.

Stephen Cohen, who's still president of Palantir, owns about 1.5% of the company's shares. He and Lonsdale worked closely with Peter Thiel, Palantir's better-known cofounder and were part of Thiel's inner circle during the company&#8217;s early days. Both men – in their early forties – now have significant fortunes due to their involvement in the company, all thanks to their early involvement and the recent surge in its value.
Palantir's recent stock jump hasn't just benefited Lonsdale and Cohen. The two other cofounders, <a href="https://www.benzinga.com/markets/24/11/42028954/peter-thiel-says-trumps-60-china-tariff-would-be-very-very-bad-for-beijing-heres-whats-at-stake">Peter Thiel</a> and <a href="https://www.benzinga.com/news/24/08/40437321/palantirs-alex-karp-defends-military-partnerships-stands-firm-on-pro-western-stance-report">Alex Karp</a>, have been billionaires for quite some time now. 'Daddy's Home' – Palantir Creates Two New Billionaires After Trump's Win. Both Own Less Than 2% Stock And Are Thiel's Favorites

Jack Mallers, CEO of payment platform Strike, has made a powerful case for the United States to embrace Bitcoin (CRYPTO: <a class="ticker" href="https://www.benzinga.com/quote/btc/usd">BTC</a>) as a <a href="https://www.benzinga.com/markets/cryptocurrency/24/11/42121376/strategic-bitcoin-reserve-wouldnt-require-new-taxpayer-dollars-says-sen-cynthia-lummis">strategic reserve asset</a>.
What Happened: In an <a href="https://x.com/jackmallers/status/1859608923344421177">interview</a> with CNBC on Thursday, Mallers compared the potential adoption of Bitcoin by the U.S. government to pivotal moments in economic history, including Nixon's departure from the gold standard in 1971.
<h3 class="wp-block-heading">A Vision For Bitcoin As A National Asset</h3>
Mallers argued that Bitcoin's decentralized and transparent nature aligns perfectly with American values such as equal rights and open opportunity. 
He described Bitcoin as &#8220;an asset that was accessible to the people 15 years ago, that the people own. Governments only own 2, 3, 4% of this asset.&#8221;
According to Mallers, embracing Bitcoin is a way for the U.S. to remain <a href="https://www.benzinga.com/markets/cryptocurrency/24/11/42098407/donald-trump-reportedly-eyeing-the-first-crypto-focused-role-in-the-white-house">competitive and innovative</a>.
"It acts in the best interest of the public. It's pro jobs, it's pro energy, it's pro industry, it's pro growth," he said. 
Highlighting the national debt crisis, Mallers rhetorically asked, &#8220;Does anyone else have a plan to get us out of debt? Are we going to start a lemonade stand out here in Times Square? No. How about the best-performing asset in the history of mankind?&#8221;

Mallers dismissed the notion that people are &#8220;too late&#8221; to invest in Bitcoin, calling it a distraction rooted in comparison to early adopters. 
"People think they're late to Bitcoin. I don't understand that. Late according to who? Over the last 15 years, the best thing you could have done is buy Bitcoin," he said. 
Mallers went on to assert that this would hold true for the &#8220;next 1,500 years.&#8221;
With the U.S. national debt ballooning and global competitors embracing Bitcoin, Mallers emphasized the urgency of acting now. 
"As a country, I think we have a choice. I think the worst thing we can do is not own enough," he warned. 
He urged the U.S. to support its homegrown crypto businesses, saying, "Coinbase (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/COIN#NASDAQ">COIN</a>) is an American company, Strike is an American company, Kraken is an American company. Let's support these businesses, let's support this industry."
<h3 class="wp-block-heading">Pro-Growth And Pro-Innovation</h3>
Mallers aligned Bitcoin adoption with the values of the <a href="https://www.benzinga.com/markets/cryptocurrency/24/11/42122348/trumps-planned-crypto-council-may-oversee-bitcoin-reserve-report">incoming U.S. administration</a>, which he sees as an opportunity to drive growth and innovation.
"As this new administration takes office, we have to make a decision. To de-risk this, we should buy some Bitcoin and push American ideals in technology and innovation through the best-performing asset and technology in mankind," he said.
