With just six weeks left in 2024, Senate Majority Leader <a href="https://www.benzinga.com/topic/chuck-schumer">Chuck Schumer</a> (D-NY) faces mounting criticism for failing to deliver on his <a href="https://www.benzinga.com/markets/cannabis/24/03/37526202/chuck-schumer-senate-will-work-very-hard-to-pass-cannabis-banking-bill-before-upcoming-elections">long-standing promise</a> of achieving cannabis banking reform. Now, he&#8217;s mounting a Hail Mary effort to get it across the finish line before the term ends.
Senators on Capitol <a href="https://login.politicopro.com/?redirect=https://subscriber.politicopro.com/newsletter/2024/11/weed-banking-hopes-rise-again-00190071">told</a> Politico they &#8220;still have hopes the cannabis banking bill can get done in the lame duck, despite the odds.&#8221; 
What Happened: Schumer, who brought the <a href="https://www.benzinga.com/topic/secure-and-fair-enforcement-safe-banking-act" target="_blank" rel="noreferrer noopener">Secure and Fair Enforcement Regulation (SAFER) Banking Act</a> (SAFER) to a <a href="https://www.benzinga.com/markets/cannabis/23/09/34929327/breaking-senate-committee-approves-cannabis-banking-reform-in-historic-vote">committee hearing</a> in September 2023, had intended to advance the bill by attaching it to must-pass legislation before the midterms. However, despite his vocal support, he did not call the bill for a full Senate vote, citing insufficient Republican backing to overcome filibuster rules. This hesitation, coupled with Democrats&#8217; shifting priorities after this month's <a href="https://www.benzinga.com/news/24/11/41768178/donald-trump-defeats-kamala-harris-to-win-2024-election">Republican electoral surge,</a> has all but killed hopes for cannabis banking reform during the lame-duck session.
And now, Senate Democrats are scrambling to address more immediate legislative tasks, including passing budget bills to avoid a looming <a href="https://www.benzinga.com/news/24/09/40931809/house-republicans-reject-their-own-funding-bill-as-government-shutdown-looms-mike-johnson-says-we-ha">Dec. 20 government shutdown</a> and finalizing judicial appointments before relinquishing control in January.
<h2 class="wp-block-heading">High Stakes As GOP Takes Congress</h2>
Senator <a href="https://www.benzinga.com/politics/24/11/41950681/trump-once-said-political-career-over-about-john-thune-now-senate-majority-leader-working-with-him-to-pass-gop-agenda">John Thune</a> of South Dakota who opposes marijuana legalization, is set to replace Sen. <a href="https://www.benzinga.com/topic/mitch-mcconnell" target="_blank" rel="noreferrer noopener">Mitch McConnell</a> as Senate majority leader. With Thune and conservative House Speaker Mike Johnson at the helm, the path to cannabis reform becomes even narrower. Johnson <a href="https://www.benzinga.com/markets/cannabis/23/10/35428675/buzz-kill-mike-johnsons-election-as-new-house-speaker-does-not-bode-well-for-cannabis-legalizati">has consistently voted against</a> most cannabis-related legislation, including banking reform.

Critics argue that Democrats, despite their rhetoric or best efforts, have fallen short of delivering substantive cannabis reform. Their missed opportunity leaves the industry bracing for continued financial instability.
Meanwhile, <a href="https://www.benzinga.com/24/11/42125955/cannabis-stocks-feel-the-burn-as-gaetz-bows-out-msos-in-focus">cannabis stocks tanked</a> last Thursday after pro-marijuana&nbsp;Matt Gaetz&nbsp;<a href="https://www.benzinga.com/24/11/42119848/matt-gaetz-withdraws-name-from-ag-nomination-calls-sex-trafficking-controversy-a-distraction" target="_blank" rel="noreferrer noopener">withdrew his nomination</a>&nbsp;for U.S. Attorney General and was replaced by the far less weed-friendly nominee Pam Bondi, a close associate of President-elect <a href="https://www.benzinga.com/topic/donald-trump">Donald Trump</a>.
<h2 class="wp-block-heading">Looking Ahead</h2>
As the likelihood of meaningful cannabis reform fades under the outgoing Democratic administration, advocates are left with no choice but to turn to the incoming Republican leadership, hoping they embrace the stance candidate Donald Trump <a href="https://www.benzinga.com/markets/cannabis/24/08/40561136/trump-dislikes-having-people-in-jail-for-cannabis-will-he-legalize-if-elected-or-just-trying-to-">expressed back in August</a> at his Mar-a-Lago residence. 
&#8220;As we legalize it, I start to agree a lot more because it&#8217;s being legalized all over the country,&#8221; the president-elect said.

Bath &amp; Body Works, Inc. (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/BBWI#NYSE">BBWI</a>) shares are trading higher after the company reported better-than-expected <a target="_blank" href="https://www.benzinga.com/pressreleases/24/11/g42159938/bath-body-works-reports-third-quarter-2024-results" rel="noreferrer noopener">third-quarter results and raised its 2024 outlook</a>.
BBWI&#8217;s third-quarter adjusted earnings per share of 49 cents, beating the analyst consensus of 47 cents.
Quarterly sales of $1.610 billion, a growth of 3.1% year-over-year, above the street view of $1.579 billion.
The gross margin was 43.5%, down 20 bps YoY, and the operating margin was 13.5% compared to 14.2% YoY.

Net cash used for operating activities year-to-date totaled $69 million, compared to cash provided of $28 million a year ago.
Bath &amp; Body Works exited the quarter with cash and equivalents of $191 million. The company&#8217;s inventories as of quarter end totaled $1.178 billion, with long-term debt of $3.88 billion.
Bath &amp; Body Works had recently declared a regular quarterly dividend of&nbsp;$0.20&nbsp;per share, payable on December 6, 2024, to shareholders of record at the close of <a target="_blank" href="https://www.benzinga.com//node/41842833" rel="noreferrer noopener">business on November 22, 2024.</a>

Q4 Outlook: Bath &amp; Body Works projects net sales to decline of 6.5% to a decline of 4.5% year-over-year, reflecting a 500-basis-point headwind from a shifted fiscal calendar. Earnings per share are expected to be between $1.94 and $2.07, versus the $1.98 consensus.
2024 Outlook: The company raised fiscal 2024 guidance and now expects net sales to decline 2.5% &#8211; 1.7% (prior view: decline of 4% &#8211; 2%), including a 100-basis-point headwind from the 53rd week in 2023. Adjusted earnings per share are projected at $3.15&nbsp;&#8211; $3.28 <a target="_blank" href="https://www.benzinga.com/calendars/guidance" rel="noreferrer noopener">(prior view $3.06&nbsp;&#8211; $3.26) versus the $3.18 consensus.</a>

On Nov. 20, BHP announced plans to invest up to $14 billion to enhance its copper production in Chile, as revealed during a three-day site tour of its operations. This substantial capital expenditure aims to secure the long-term future of its assets in the region and support the growing global demand for copper.
Cramer said Diamondback Energy, Inc. (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/FANG#NASDAQ">FANG</a>) is a buy.
On Nov. 4, Diamondback Energy reported quarterly earnings of $3.38 per share, which missed the analyst consensus estimate of $3.99 per share. The company reported quarterly sales of $2.65 billion which beat the analyst consensus estimate of $2.44 billion.
When asked about AMC Entertainment (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/AMC#NYSE">AMC</a>), he said, &#8220;If it gets to six, I want you to sell it. Period. End of story.&#8221;
On Nov. 12, the company disclosed a debt retirement move in a SEC filing. The company said it entered into a series of privately negotiated agreements to retire $24.22 million in unsecured debt through 5.75% subordinated notes due 2025 <a href="https://www.benzinga.com/trading-ideas/movers/24/11/41952040/amc-entertainment-shares-are-on-the-rise-today-whats-going-on">between Nov. 8 and Nov. 12</a>.
Copart, Inc. (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/CPRT#NASDAQ">CPRT</a>) is a &#8220;remarkable&#8221; company, Cramer said. &#8220;I need to see a pullback in Copart.&#8221;
On Nov. 21, Copart reported better-than-expected sales results for the first quarter.
