A new Morning Consult poll of likely voters show Harris' lead holding steady at three points ahead of the presidential debate.
The new <a href="https://pro.morningconsult.com/trackers/2024-presidential-election-polling?utm_source=briefing&amp;utm_medium=email&amp;utm_campaign=washington_am&amp;utm_content=091024">poll </a>shows the following results form voters, with the results from the<a href="https://www.benzinga.com/general/politics/24/09/40759548/harris-vs-trump-vice-president-on-top-by-three-points-how-her-lead-compares-to-the-2020-election"> Sept. 3 poll</a> in parentheses.

</ul>
The poll found that 94% of Democrats backed Harris as their top pick, up one percentage point from last week's poll. The poll also found that 91% of Republicans backed Trump as their top pick, which was in line with last week's poll.
Independent voters selected the following as their head-to-head preference, with the results from the Sept. 3 poll in parentheses:

Harris maintained a six-point lead in the race for Independent voters, with both candidates losing one percentage point from the previous poll.
The vice president also has the edge in the 18-34 aged voters demographic leading 53% to 43%. The 10-point lead is significantly higher than a five-point advantage (50% to 45%) in last week's poll.

Why It's Important: The latest Morning Consult poll and the one before it has shifted to include only the results of likely voters and not all registered voters. This could provide one of the better illustrations of what could happen in November.
Harris continues to rank ahead of Trump in the weekly head-to-head poll, maintaining a lead each week since the head-to-head update in the poll took place with President Joe Biden stepping down in the 2024 election.
Harris' lead is smaller than one that Biden had against Trump at this stage in the 2020 election. With two months to go before the 2020 election, Biden led Trump by eight percentage points among likely voters 51% to 43%.
This suggests that this year's presidential election could be closer than in past years.
The latest Morning Consult poll found that Harris' popularity has declined among likely voters. The vice president's net favorability is only one point, with voters only one point more likely to hold favorable opinions of Harris than those who hold unfavorable opinions (50% to 49%). For comparison, Trump's net favorability is negative 10 points with more likely voters having an unfavorable opinion than favorable one.
Morning Consult released the results of likely voters<a href="https://www.benzinga.com/topic/swing-states"> in swing states </a>and several other states expected to be close. Wisconsin: 49% Harris, 46% Trump
In the key seven swing states, Harris leads in three states, Trump leads in one state and the two candidates are tied in three states.
The poll that follows next week could be one of the most closely watched as it will consider the answers from likely voters after Harris and Trump faced off for the first time in Tuesday's presidential debate.

Harris Vs. Trump: Vice President Holds 3-Point Lead Ahead Of Presidential Debate, But Swing States Still Close, Up For Grabs

Bank of America Corp (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/BAC#NYSE">BAC</a>)&nbsp;CEO Brian Moynihan <a href="https://www.benzinga.com/markets/equities/24/09/40792082/whats-going-on-with-bank-of-america-stock-on-tuesday">praised Warren Buffett</a> on Tuesday as an investor in the company, but said he has not asked the legendary investor why he has lowered his position in Bank of America.
&#8220;He has been a great investor for our company, stabilized our company,&#8221; Moynihan said about Buffett during an investor conference in New York, Reuters reported. &#8220;I don&#8217;t know what exactly he is doing because frankly we can&#8217;t ask.&#8221;
Buffett&#8217;s Berkshire Hathaway (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/BRK#NYSE">BRK</a>) the biggest shareholder in BofA,&nbsp;has been reducing its stake in the U.S. bank, making total share sales since mid-July of nearly $7 billion.
Berkshire&#8217;s stake in Bank of America stands at about 11.1%, according to LSEG data.

Moynihan also discussed the proposed changes in capital rules after the Federal Reserve Chairman Jerome Powell laid out a plan on Tuesday to raise big bank capital by 9%, significantly reducing an earlier proposal after intense Wall Street pushback.
Moynihan said the proposed changes are manageable for Bank of America, and it will keep buying back stock, but warned that higher capital requirements for large banks could reduce lending.
&#8220;If our capital goes up by 10%, it stops us from making $160 billion (in) loans we would otherwise make. Those loans would go to small businesses and middle-market companies at competitive rates,&#8221; he said.
Speaking about performance in the third quarter, he said investment banking revenue could be around $1.2 billion, a slight uptick from $1.18 billion in revenue posted in the same quarter a year earlier.
BAC Price Action: Bank of America fell 0.48% to close at $39.28 on Tuesday.
Exchange-traded funds that hold the stock also trended downward.

Bank Of America CEO On Buffett's Share Retreat: 'I Don't Know What Exactly He Is Doing ... We Can't Ask'

Missouri Governor Mike Parson and Attorney General Andrew Bailey <a href="https://governor.mo.gov/press-releases/archive/governor-parson-attorney-general-bailey-announce-new-actions-combat-spread">announced</a> new actions to regulate psychoactive cannabis products in the state.
Their decision follows California's <a href="https://www.benzinga.com/markets/cannabis/24/09/40761471/cheech-and-chongs-cannabis-company-responds-to-gov-newsoms-ban-on-hemp-products-containing-any-d">crackdown on hemp</a>, led by Governor Gavin Newsom, which has sparked concern among industry leaders. 
Missouri&#8217;s new actions to combat unregulated cannabis, introduced through a joint task force between the Attorney General's Office (AGO) and the Division of Alcohol and Tobacco Control (ATC) aim to combat the spread of unregulated psychoactive hemp products.
Governor Parson echoed a familiar argument citing the protection of children as a primary reason for the crackdown. 
&#8220;Together, with the help of the Attorney General and his team, we will root out these cannabis products being deceptively marketed to our children until such time the General Assembly provides the statutory framework for commonsense regulations,&#8221; Parson said in a press conference.
<h3 class="wp-block-heading">&#8216;Protect The Children&#8217;</h3>
&#8220;We are building on our existing investigation into these harmful, illicit products by formalizing a unit within my Consumer Protection Division that will be dedicated to investigating referrals from the ATC&#8221; said Attorney General Bailey. &#8220;We will enforce the law to protect our children every step of the way."
The AGO and ATC will form a joint task force. Under this partnership, the ATC will investigate its licensees selling unregulated psychoactive cannabis products, collect evidence of deceptive marketing and refer cases to the AGO. In response, the AGO will create a specialized unit within its Consumer Protection division to review these referrals.
This unit will use the Missouri Merchandising Practices Act (MMPA) to take legal action against licensees engaging in prohibited practices related to psychoactive cannabis products.

With the hemp industry increasingly in the crossfire, the state&#8217;s enforcement measures are expected to have serious implications for businesses as they struggle to adapt to the<a href="https://www.benzinga.com/markets/cannabis/24/07/39690898/no-more-getting-high-on-hemp-in-america-multiple-states-begin-intoxicating-hemp-crackdown"> evolving regulatory landscape.</a> 
Meanwhile, the Missouri Department of Health and Senior Services (DHSS) will continue to embargo unregulated psychoactive cannabis food products that don&#8217;t meet state and federal requirements. Since September 1, DHSS has inspected 64 facilities and found 39 locations with unregulated cannabis products on shelves. To date, 8,929 products have been embargoed through these actions, the Office of the Governor says.

Hemp leaders argue that such regulations will severely hurt small businesses and limit consumer access to legal, non-intoxicating products.

A coalition of cannabis advocates is ramping up pressure on President Joe Biden to act on his promise of <a href="https://www.benzinga.com/markets/cannabis/24/06/39319868/meet-the-man-who-did-prison-time-for-non-violent-cannabis-offense-and-now-advocates-for-others-i">cannabis justice. </a>
On Tuesday, the Last Prisoner Project (LPP) and several partner organizations announced the Countdown for Clemency campaign, urging Biden to grant clemency to nearly 3,000 individuals still incarcerated for federal marijuana offenses, Marijuana Moment <a href="https://www.marijuanamoment.net/marijuana-reform-advocates-launch-countdown-to-clemency-campaign-pressing-biden-to-free-cannabis-prisoners-before-his-term-ends/">reported.</a>

<h3 class="wp-block-heading">Activists Call For Broader Action</h3>
Despite Biden&#8217;s past efforts, which included pardoning thousands of people with federal cannabis possession convictions, no one has been released from prison as a result. 
The new campaign is pushing the president to use his clemency powers to right this wrong. "Time is running out on President Biden's term, but it is not too late for him to undo the harms inflicted on families impacted by cannabis criminalization," said Sarah Gersten, executive director of LPP.
The campaign's website features a large countdown clock, symbolizing the dwindling time before Biden's term ends. While Biden's pardons have helped people clear their records, the administration has not commuted the sentences of those still behind bars for cannabis-related offenses.
Recent polls show that Americans overwhelmingly support clemency for those incarcerated for marijuana offenses, now legal in many states. 84% of voters support releasing people serving time for cannabis crimes, while 72% approve of Biden's previous pardons for non-violent possession convictions.
<h3 class="wp-block-heading">Congressional Push Adds Weight</h3>
The campaign for clemency has gained momentum in Congress, where 36 lawmakers wrote to Biden in March, urging him to commute the sentences of non-violent cannabis offenders. 
Biden, however, has maintained a cautious stance. At a Wisconsin campaign stop earlier this year, he expressed his support for rescheduling marijuana but drew a distinction between users and dealers. "If you're out selling it, if you're out growing, it's a different deal," Biden said.
<h3 class="wp-block-heading">The Clock Is Ticking As November Elections Loom</h3>
With the 2024 election approaching, the administration appears aware of the growing public demand for cannabis reform. 
Both Biden and Vice President Kamala Harris have emphasized their efforts to address the issue, including a carefully timed announcement on April 20, a significant date in cannabis culture.
Harris has also publicly called on the Drug Enforcement Administration (DEA) to speed up its review of marijuana's classification under federal law.
With only months left in Biden&#8217;s presidency, the clock is ticking for thousands of individuals still serving time for cannabis offenses.
