Oregon's Final Rules For Psilocybin Services Are Ready, Learn What To Expect

Following the November midterm results on local opt-outs, the Oregon Health Authority (OHA) announced it has adopted the final subset of rules “to regulate the production of psilocybin products and the provision of psilocybin services” -aka the Oregon Psilocybin Services Act, BM 109, and now ORS 475A,- constituting the first comprehensive and operative regulatory framework for psilocybin services in the US.

The rulemaking process went through different stages, starting with gathering information for the Rules Advisory Committee (RAC), public hearings, a public comment period and then concluding with the first subset of regulations on psilocybin product testing and training programs in May 2022.

The same process took place later this year, starting with RAC gatherings until September 2022, this time discussing proposed rules on packaging, labeling and product transportation; licensing, facilities, and operations; facilitator conduct, preparation, administration and integration sessions.

The second set of public hearings and public comment period took place in November and led to the final rules now summarized in two published documents: a Hearing Officer Report (HOR,) and a Letter to the Public including a copy of the final, adopted rules.

The HOR describes the feedback process established between the public hearings and comments and the agency’s final decisions on a wide array of topics concerning psilocybin services regulations -with some gains and some losses among amendment requests.
