Could Elon Musk Sue OpenAI For Fraud? Here's His 3-Word Response

Artificial intelligence is among the biggest trends in 2023, led by the increase use cases powered by ChatGPT and its parent company OpenAI. Credited as a co-founder and previous investor of OpenAI, Elon Musk is now critical of the artificial intelligence company.

What Happened: Artificial intelligence was a hot topic issue discussed between Musk and Tucker Carlson during an interview on Fox News.

In the first of two interviews set to air on the Fox Corp FOX FOXA-owned news network, Monday’s interview saw Musk discuss artificial intelligence and OpenAI.

“AI is more dangerous than, say, mismanaged aircraft design or production maintenance or bad car production, in the sense that it has the potential – however small one may regard the probability, but it is not trivial – it has the potential of civilian destruction,” Musk said.

Musk said during the interview with Carlson that he is planning to launch an OpenAI rival called “TruthGPT.”

“I’m going to start something which I call ‘TruthGPT,’ or a maximum truth-seeking AI that tries to understand the nature of the universe,” Musk said.

Musk has criticized OpenAI, the company he helped co-found, for “training the AI to lie” and being a “closed source” for-profit instead of the originally planned nonprofit.

During the interview, journalist Benny Johnson tweeted that he was watching Musk and Carlson and thought maybe Musk had been wronged by his previous involvement with OpenAI.

“Watching this fascinating Tucker v. Elon interview. Why does @elonmusk not sue Open AI for defrauding him? Seems like a slam dunk,” Johnson tweeted.

Musk offered a reply a few hours later.

“Wait for it … ” Musk replied.

Why It’s Important: Musk has criticized OpenAI, a company that now counts Microsoft Corporation MSFT among its largest investors, on several occasions.

OpenAI has shown political bias and also might need regulation, even signing a pledge that OpenAI should pause, he has said. 

Musk said previously that OpenAI was created to be a counterweight to Google, the search engine from Alphabet Inc GOOG GOOGL. The plan was for OpenAI to be open-source and a nonprofit, he said. 

“Now it (OpenAI) has become a closed source, maximum-profit company effectively controlled by Microsoft. Not what I intended at all,” Musk replied to a user on Twitter.

The Tesla, Twitter and SpaceX CEO has said that he wanted to run OpenAI by himself, but co-founder and current OpenAI CEO Sam Altman and others turned him down on his proposal.

A report from Semafor says Musk went back on a promise to donate $1 billion to the OpenAI project after walking away, but had contributed around $100 million before leaving.

It is unclear if Musk will sue OpenAI, but his comments on Twitter show that he may have at least considered litigation. 

The launch of TruthGPT and its progress will be closely monitored, and it could become a key rival for ChatGPT and OpenAI.
