Trump Investigation By Special Counsel Wrapping Up: Former President Could Face Serious Prison Time For Classified Docs

Special Counsel Jack Smith’s investigation into former President Donald Trump‘s alleged refusal to return classified documents following his 2020 election defeat is reportedly nearing completion.

What Happened: Smith is expected to announce the results of his investigation shortly after Memorial Day, according to Bloomberg, which cited people familiar with the matter.

Depending on Smiths’ findings, Trump could potentially face a maximum of 33 years in prison. The possible charges include obstruction of justice, which can lead to a 20-year sentence; Espionage Act violations, which come with a maximum sentence of 10 years; and improper handling of government documents, punishable by up to three years. These possibilities are outlined in a search warrant issued last year.

Although, any charges from Smith’s investigation require approval from both Attorney General Merrick Garland and a federal grand jury. If charges aren’t brought, Smith would be expected to present his reasoning to Garland, who could then decide whether to make the report public.

The former president is also facing inquiries in other jurisdictions. This includes Atlanta-area District Attorney Fani Willis, who is investigating purported attempts to reverse President Joe Biden‘s 2020 election victory. Additionally, New York Attorney General Letitia James is conducting a civil investigation into alleged misrepresentations of asset values.

Bloomberg also reports a similar circumstance where a distinct special counsel is investigating Biden for his management of classified documents, though the specifics of this investigation are yet to be clarified.

Polling Info: Trump leads Biden by four percentage points, with 47% support to Biden’s 43%, according to data from FiveThirtyEight, with surveys conducted from May 17-24 by McLaughlin & Associates.

Trump also leads Governor Ron DeSantis in polls of 2024 Republican presidential candidates. In a recent poll conducted during the same period, Trump secured 61% support from GOP voters, a 43-point lead over DeSantis’ 18%. Although, that was prior to DeSantis officially announcing the launch of his 2024 presidential campaign on Wednesday.
