Liberal Groups May Obstruct Trump's 2024 Run Using The Constitution's 'Insurrection' Clause

Former President Donald Trump‘s 2024 White House run may be obstructed by liberal groups and legal experts citing a rarely used section of the Constitution, aimed at preventing his candidacy.

According to AP News, the contention revolves around the 14th Amendment. It prohibits anyone who has sworn to uphold the Constitution but subsequently engaged in “insurrection or rebellion” against it from holding office.

Liberal nonprofits have vowed to challenge in court if election officers list Trump on the ballot despite these objections. The issue could trigger a chain of lawsuits and appeals leading to the U.S. Supreme Court, potentially in the midst of the 2024 primary season.

Two conservative law professors, William Baude and Michael Paulsen, have supported this argument in a law review article, asserting that Trump must be barred from the ballot due to the clause in the third section of the 14th Amendment.

Trump’s potential disqualification was discussed in a recent Republican presidential debate. The topic has gained momentum, with discussions underway among top election officials in all 50 states.

Trump has dismissed these efforts as “election interference”, equating them to the criminal charges against him. Legal challenges against Trump’s candidacy could be filed as early as October, when states start setting their ballots for the upcoming primary.

The debate raises complex legal questions, with implications for the 2024 election and beyond. It throws into relief the continuing political and legal fallout from the attack on the U.S. Capitol on Jan. 6, 2021.
