Donald Trump's 2024 Presidential Ambitions Face Serious Threat From Colorado Case Than Criminal Trials, Says Former Attorney

The political future of former President Donald Trump hangs in the balance as a Colorado lawsuit seeks to disqualify him from the 2024 presidential race.

What Happened: Dean Obeidallah, a former attorney, in an op-ed for CNN, said the lawsuit filed by a liberal watchdog group aims to block Trump from holding office by leveraging Section 3 of the 14th Amendment “could be more of a threat to Trump's candidacy.”

The lawsuit, set for trial later this month, focuses on Trump’s involvement in the Jan. 6, 2021, events. The 14th Amendment’s clause disqualifies U.S. officials who “engaged in insurrection” or “given aid or comfort” to insurrectionists from holding office in the future.

“This suit — if successful — could be more of a threat to Trump's candidacy than his criminal cases. Why? Trump could be convicted in any of his criminal cases, yet there is no constitutional prohibition that bars him from running for president,” Obeidallah wrote.

“However, if Trump loses this case over the 14th Amendment — or any of the similar ones in states such as Michigan and Minnesota — his name would not appear on the ballot in those states since he would be deemed constitutionally disqualified to be a candidate for president,” he added.

Why It Matters: This came after Colorado District Judge Sarah Wallace on Friday discarded three arguments from Trump and the Colorado GOP aimed at dismissing the lawsuit before trial. While Trump still has a motion pending to toss the lawsuit, his campaign has criticized the judge’s rulings.

However, Judge Wallace has not yet ruled on whether the 14th Amendment can be applied to remove a presidential candidate from the ballot. This issue, among others, will be addressed in the forthcoming trial.

This lawsuit is not the first legal hurdle Trump faces in his potential 2024 run. However, its outcome could set a significant precedent. If the case is successful, it may initiate a series of similar lawsuits in other states, further complicating Trump’s road to the presidency.
