"Lithium reacts violently with water,” McGinty explained. “If it’s thrown in the garbage, there’s actually a lot of water in the garbage from other stuff decomposing. … Somewhere down the line … it is an explosion and fire hazard risk."

California's Regulatory Response

In response to these dangers, California implemented AB 1894, signed by Governor Gavin Newsom in 2022. This law, effective July 1, 2024, regulates the disposal of cannabis vaporizers. It prohibits consumers from discarding cannabis cartridges or integrated vaporizers in the trash. It also mandates proper disposal at hazardous waste facilities. The regulation also requires clear labeling on packaging to inform consumers about proper disposal methods.

Industry Solutions and Collaborations

Many cannabis retailers in California have initiated vape pen collection programs to comply with the new regulations. McGinty's company has partnered with hundreds of retailers to collect used vape pens, separate the batteries for recycling, and repurpose the cartridges for use in asphalt products.

Amber McConnell, forensic chemistry manager at the Maryland State Police, noted the importance of accurate disposal for legal reasons: "Our reports will then be used in court to say whether or not a person has a controlled substance."
