Marathon, sometimes characterized as a patent troll, traded recently down more than 3 percent at $6.60. Its shares are off more than 15 percent in the past month.
The litigation is part of a raft of related suits brought in November 2013 by Marathon's Vantage Point Technology Inc. unit against a host of major companies alleging infringement of a computer access memory patent.

Other defendants include Texas Instruments, Amazon.com Inc. AMZN, Apple Inc. AAPL, Microsoft Corp. MSFT NVIDIA Corp. NVDA and Lenovo Group Ltd. LNVGY.
Texas Instrument's efforts to challenge the patent's validity appeared to suffer a setback last month when its request for inter partes review of the case was denied by the Patent Trial and Appeal Board.

Marathon Chief Executive Douglas B. Croxall said at the time he hoped the action "will encourage the parties in suit to reach reasonable licensing arrangements."
The 1995 U.S. Patent No.5,463,750, was issued to Intergraph Corp. and subsequently acquired by Marathon. The patent concerns a method for translating virtual addresses in a data processing system.
